USA Safety Corp Auto Transport

This document constitutes our terms and conditions (“Terms” or “Agreement”). These Terms are a legally binding agreement between you (“you” or “customer”) and USA Safety Corp. USA Safety Corp Auto Transport provides vehicle transportation services, including but not limited to, door-to-door delivery, terminal-to-terminal shipping, and express shipping options. Our services are designed to ensure prompt and secure delivery of your vehicle.

Customer’s Responsibilities

Customers are responsible for providing accurate and complete information regarding the shipment, including the pick-up and delivery addresses, contact information, and vehicle details. Customers must ensure the vehicle is ready for transport at the agreed-upon time and location.

Customer Warranties

Customers warrant that they have lawful possession of the vehicle and the right to authorize its transportation. They guarantee that the vehicle is in safe operating condition, free of hazardous materials, and properly insured.

Pickup and Delivery of Shipment

The Company will arrange for the Carrier to pick up and deliver the vehicle as per the agreed schedule. The Customer must ensure someone is available to release the vehicle to the Carrier and receive it at the delivery location. Delays caused by the Customer may incur additional charges.

Carrier Responsibilities

The Carrier is responsible for the safe and timely transport of the vehicle. The Carrier must inspect the vehicle at pick-up and delivery, noting any existing damage. The Carrier will provide updates on the shipment status as required.

Fees and Payment

Customers agree to pay all fees associated with the transport services as outlined in the Agreement. Payment is due at the time specified in the Agreement. The Company reserves the right to charge additional fees for services rendered outside the scope of the original Agreement.

Cancellation and Refund Policy

Customers may cancel their shipment request by providing written notice to the Company. Cancellations made more than 24 hours before the scheduled pick-up will receive a full refund. Cancellations made within 24 hours of the pick-up may incur a cancellation fee.

Loss, Damage, or Delay Claims

The Company and Carrier are not responsible for personal items left in the vehicle or any damage to such items. In the event of vehicle damage, loss, or delay, claims must be reported in writing within 24 hours of delivery. The Carrier’s liability is limited to the actual cash value of the vehicle.

Indemnification

Customers agree to indemnify and hold harmless the Company, its employees, and agents from any claims, damages, or expenses arising out of the Customer’s breach of these terms or the Customer’s negligence or misconduct.

Disclaimer and Limitation of Liability

The Company provides services “as is” without any warranties, express or implied. The Company is not liable for any indirect, incidental, or consequential damages resulting from the use of its services. The total liability of the Company for any claim arising from this Agreement shall not exceed the amount paid by the Customer for the services.

Customer order

To order services, you must provide accurate information identifying the vehicle to be transported, whether the vehicle is available, pick-up and delivery addresses, desired pick-up date, name and contact information of the person responsible for being present at the time. For receipt and delivery, the type of shipment desired (for example, open or closed carrier) and the number of the credit/debit card used for payment. Once you have provided your order details, USA Safety Corp will send you an email with your order details (“Order Confirmation Email”).

Fees

When a customer orders services. You agree to pay in full the fees for the Services and any additional fees that may arise under this Agreement. All amounts due shall be paid in full when due and shall not be disputed or set off for damages or for any other reason (including, without limitation, your dissatisfaction with the Service). Once paid, fees are non-refundable unless canceled by USA Safety Corp

Carrier Notice

You will receive an email notification (using the email address provided on your order) when a carrier has been dispatched to deliver your vehicle. The delivery email (delivery notification email) will include carrier information and estimated pickup and delivery dates.

Preparation before transporting vehicles

To prepare the vehicle for transport before the specified pick-up time, you must do the following:

a) Remove and secure all loose parts, fragile accessories, low-hanging spoilers, etc.

b) Remove all non-permanent, externally mounted racks and other racks

c) Remove or disable any payment transponders or other sensors that may charge your account. Please note that any charges incurred by the customer are 100% the responsibility of the customer.

d) Ensure that your vehicle is in good working order (unless otherwise specified in the order) and that the fuel tank is between 1/4 and 1/2 full.

e) disable any alarm system or provide the Carrier with keys and instructions for arming/disarming any alarm system, if an alarm sounds and there is no key or instruction to disable it, the Carrier may silence the alarm by any means and shall not be liable for any damages and.

f) Remove all personal belongings and sensitive materials and do not store any dangerous or illegal items (including but not limited to explosives, firearms, ammunition, fireworks, flammable materials, alcohol, legal or illegal drugs, money, legal items) in the vehicle.

Vehicle transport

By placing an order, you authorize the shipping company to drive and transport your vehicle between the pickup and delivery locations and to perform such actions as the carrier deems necessary to complete such transportation, including driving the vehicle. USA Safety Corp or the carrier will contact you prior to collection or delivery to inform you of the estimated time and location of collection or delivery. The Carrier will attempt to make the actual Pickup and Delivery location as close to the address requested as possible, taking various factors into account, including, without limitation, transportation restriction laws and safety. These factors may require you and the Carrier to designate an alternative Pickup/Delivery location other than the one you originally requested. If you are unable to arrive at the specified pickup/delivery location at the specified time, you must designate another person (must be 18 years of age or older) with the carrier to act as your pickup/delivery agent. You are solely responsible for the acts and omissions of your nominee/agent. You and/or your authorized representative/agent and your vehicle must be present at the pick-up location at the specified time or you risk cancellation of your order and cancellation fees. If you or your authorized representative/agent are not at the delivery location at the specified time, your vehicle may be stored and/or delivery may be delayed, each at your own expense.

DELIVERY

At the time the vehicle is taken to the delivery location (“Delivery”), you and the carrier must carry out a full inspection of the vehicle for any external damage that may have occurred during transport. The results of this inspection must be recorded in the inspection report on the waybill. Any new damage to the vehicle (compared to the condition of the vehicle at the time of collection) should be noted in the package inspection report. You and the carrier must confirm the condition of the vehicle by signing the waybill. It is your responsibility to obtain and retain a copy of the original bill of lading for your records. By signing a bill of lading with no noted damage, you acknowledge that you will receive the vehicle in good condition and without damage, releasing USA Safety Corp and the carrier from any claim or liability for damage to your vehicle.

Contract

Customer and USA Safety Corp acknowledge that they have fully participated in the review and revision of these Terms and have had the opportunity to seek advice from legal counsel. Rules of construction intended to resolve ambiguities to the detriment of the drafting party shall not be applicable in the interpretation of this Agreement.

NO WARRANTIES

The carrier collects and delivers your car as close to your door as possible (only if it is legal and safe to do so). Due to narrow streets, power lines, trees, and possible residential restrictions, a mutually agreed loading and unloading place may be necessary. USA Safety Corp will provide customers with estimated pickup and delivery dates. Collection or delivery times and dates are not guaranteed. Delays may occur before and/or during shipment due to road conditions, weather, and mechanical issues. USA Safety Corp shall not be liable for any damage or loss caused by any delay or otherwise, car rental charges or accommodation charges. USA Safety Corp is not responsible for faults in the mechanical or functional parts of your vehicle.
